How does a foreign producer arrange Czech EPR representation?

First, establish who the producer is

We check the company, sales model and packaging covered by the proposed mandate. In the relevant cross-border producer categories, PPWR requires a written authorised-representative appointment for the Czech market. The mandate should identify the producer and scope; it does not turn the representative into the manufacturer of the goods.

Kodo is registered with EKO-KOM as an authorised representative. That status does not register a new client by itself. We review the producer's data and the responsibilities on both sides before accepting an appointment.

The EKO-KOM onboarding sequence

EKO-KOM publishes a separate process for foreign producers using a representative. Its process begins with the representative's registration, followed by the producer's own registration and request for an agreement with that representative.

• Confirm the representative's registration, then submit the foreign producer's details using the appropriate EU or non-EU route.
• EKO-KOM prepares the collective-compliance agreement involving EKO-KOM, the producer and the representative; all three parties sign.
• The representative receives the annual-fee invoice. After payment, EKO-KOM issues confirmation of participation with the producer's EPR registration number.
• Agree who supplies packaging evidence, who checks it, and how quarterly reporting and EKO-KOM correspondence will be handled.

An existing agreement does not need a blind restart

If the foreign producer already has an EKO-KOM collective-compliance agreement, EKO-KOM says a new agreement with the representative is needed, but the original agreement does not have to be terminated first. Existing liabilities and receivables are settled as the arrangement changes.

The three-party terms make responsibility real for both producer and representative. The producer must provide accurate company, product and packaging information. The representative receives reporting requests and invoices and acts in the agreed role; it cannot promise to eliminate the producer's contractual responsibility.

Two kinds of registration should not be conflated

EKO-KOM onboarding and the resulting producer number are part of its collective-compliance system. PPWR Article 44 separately envisages national producer registers. The Czech implementation of that statutory register remains a moving point; an EKO-KOM confirmation must not be presented as conclusive proof of entry in a different register.

We monitor the official process and explain which document the producer actually has, what it covers and what may still be required when national procedures are available.
